UNDER the Act of Union in 1707, Scotland retained separate control over its church, law and education system and guarded their independence jealously through the centuries before devolution.

For the role of the High Court of Justiciary as the final court of appeal for criminal cases in Scotland to be transferred to the UK Supreme Court therefore will strike many as overturning one of the basic tenets of Scottish identity.
