IN RESPONSE to the fact that mortgage repossessions are up 34per cent on last year, the Scottish Executive's spokeswoman reassures us that figures should be treated with caution as not every decree leads to homelessness, and that Section 11 of the Homelessness, etc (Scotland) Act, 2003, requires creditors to provide councils with advance warning, so repossession is a last resort (May 24).

With respect, these statements are misleading and factually incorrect. First, the Scottish Executive has previously indicated that Section 11 would be brought into force in late 2005, then early 2006. It is still not in force. So there is no advance warning here. Why rely on something that currently has no relevance to people being taken to court for repossession?
